Control of Dogs

223. Deputy Seán Kyne asked the Minister for the Environment, Community and Local Government if the dog breeds regulated for under the Control of Dogs Act 1998 are legally exempt from the restrictions when being used in roles such as guide dogs for the blind, assistance, disability or therapy; if these regulations impact those travelling here from abroad who may have these dog breeds in any of these roles; and if he will make a statement on the matter. In accordance with the Control of Dogs Regulations 1998, the requirement for dogs of certain breeds to be securely muzzled in a public place and being led by a sufficiently strong chain or leash, by a person over the age of sixteen years who is capable of controlling the dog, does not apply to dogs being used for the purpose of guidance by persons unable to find their way without guidance. Dogs of the restricted breeds used for assistance, other than in accordance with the 1998 regulations, are not exempt from the requirements of the regulations to be securely muzzled etc.

The 1998 Regulations apply in respect of dogs accompanying persons travelling here from abroad.

Broadband Service Provision

The Government’s Statement of Priorities for the period 2014 to 2016 reaffirms our commitment to delivering a State-led broadband intervention in rural areas. Through the National Broadband Plan (NBP) the Government aims to ensure that high speed broadband is available to all citizens and businesses in Ireland. This is being achieved through measures designed to accelerate commercial investment and the development of a State-led intervention for non-commercial areas.

Under EU State Aid Guidelines Member States cannot intervene where commercial investors have plans to roll out services. A comprehensive mapping exercise is underway in my Department to identify those areas that require a State intervention. An initial list of areas has already been identified and includes 48 areas in County Limerick including Carrigkelly.

As part of the mapping process, an initial stakeholder consultation on certain technical aspects of the proposed Plan was launched in June with a deadline of 15th September last. 31 submissions were received as part of this process and non-commercially sensitive versions of these responses will be published by my Department over the coming weeks.

I expect to publish a map later this year which will allow members of the public to see the precise areas of the country where, based on current information provided by the various commercial operators, it is intended that the proposed Government intervention will cover. Those accessing this map will be able to identify their own house or premises and see whether or not it is in the proposed national intervention footprint. Where a house or premise is excluded from the proposed intervention it means it either currently, or will in the near future, have access to commercial NGA services. The map will be dynamic and will be subject to change if new commercial investments are announced in the future.

A further public consultation on a detailed intervention strategy will be launched in mid-2015.

EU State Aid clearance will be required for the State intervention. My Department will be working closely with the European Commission on this important aspect of the programme.

Finally, a detailed procurement process will have to be undertaken in order to select a potential preferred bidder(s) prior to commencing the roll out of high speed broadband services.

This complex and ambitious project is a key priority for Government and for my Department. It aims to conclusively address current connectivity challenges in a sustainable and meaningful way. Our goal is to ensure that quality broadband services are available to all citizens regardless of where they are located.

Inland Fisheries Ireland

Deputy Éamon Ó Cuív asked the Minister for Communications, Energy and Natural Resources the number of vacancies at present on the board of Inland Fisheries Ireland; the way and when these vacancies will be filled; if they have been advertised; and if he will make a statement on the matter. There are currently no vacancies on the Board of Inland Fisheries Ireland (IFI). A vacancy will arise on the Board, in the normal course of events, on the 3rd of November 2014. In accordance with Section 12 of the Inland Fisheries Act 2010, this vacancy will fall to be filled on advice received from the Joint Oireachtas Committee (in this case Transport and Communications). To be of assistance to the Committee and with the agreement of those who applied, details of those who have made expressions of interest to be considered for appointment to vacancies on the Board of IFI are being made available by my Department to that Committee.

Radio Broadcasting

The Broadcasting Act 2009 provides for the development of digital radio in Ireland. This Act gives RTÉ the power to establish and operate a multiplex for the purposes of providing a digital sound broadcasting service and gives the Commission for Communications Regulation (ComReg) responsibility for licensing spectrum in respect of digital sound broadcasting services. In addition, it provides that the primary responsibility for ensuring the development of commercial digital radio rests with the Broadcasting Authority of Ireland.

In regard to the current availability of Digital Audio Broadcasting (DAB) services in Ireland, RTÉ operates a DAB service from five sites around the country and there is also a commercial trial DAB service operating from Three Rock Mountain near Dublin. It should also be noted that RTÉ's national radio services and a number of RTÉ digital radio services are available to virtually the whole population on RTÉ's SAORVIEW and SAORSAT platforms. In addition, the 2009 Act permits the services of analogue sound broadcasting contractors to be retransmitted in a digital format on UPC and other cable television systems and a number of radio services are available in a digital format via this medium, including RTÉ radio services and those of a number of local and national sound broadcasters.

While there are no plans at present to roll out DAB services on a national basis, the BAI will continue to monitor and consider the potential for the development of digital radio in Ireland. In this regard, the BAI has supported various DAB trials, has organised research and has indicated in its Work Plan for 2014 to 2016 its intention to further discuss the potential for DAB or other types of digital radio services through stakeholder meetings during the period covered by the plan.

Rural Transport Services Provision

The National Transport Authority (NTA) has responsibility for the regulation of the small public service vehicle (SPSV) industry under the provisions of the Taxi Regulation Act 2013. It also responsible for the administration for the Rural Transport Programme.

Broughan asked the Minister for Transport, Tourism and Sport if he is satisfied with the nature of the information contained on the online SPSV register maintained by the National Transport Authority in accordance with the Taxi Regulation Act; and if he is concerned that the home addresses of taxi drivers are available to requesters for a relatively nominal fee. The register referred to by the Deputy is maintained by the National Transport Authority pursuant to section 18 of the Taxi Regulation Act 2013.  

This is a typical legal provision relating to the regulation of business which is designed to promote transparency in terms of licensed and unlicensed operators. I am not aware that this provision creates particular difficulties in the SPSV industry that outweigh these transparency benefits.

Ports Development

In early 2013, my predecessor Mr. Leo Varadkar T.D. commissioned a Strategic Review of Rosslare and that report was considered by Government in early 2014. The report concluded that the creation of an independent port company for Rosslare would be extremely difficult due to the legal structure of the port given that any such move would require legislation both in the Oireachtas and the British Houses of Parliament. Rather the report recommended that Rosslare Europort should remain in public ownership, in this case within Iarnród Éireann, but that the possibilities for private sector involvement and management of the port should be investigated.  

It is intended that Iarnrod Eireann will establish a Stakeholder Council to assist with exploring options for a long term concession of the port.  Members of this group are currently being identified and it is hoped to have this Council in place shortly.  This will include representation from the Local Authority, regional tourism, transport & general business interests, local fishing interests, local worker representatives, port users and port management.

Regional Airports

Deputy Dara Calleary asked the Minister for Transport, Tourism and Sport the supports that will be available for Ireland West Airport Knock as a consequence of budget 2015; if support will be made available from any other Government source; and if he will make a statement on the matter. The Exchequer currently provides financial support under the Regional Airports Programme to four regional airports, Donegal, Ireland West Airport Knock (IWAK), Kerry and Waterford. There are three schemes operated under this programme - Core Airport Management Operational Expenditure Subvention (OPEX) Scheme; Regional Airports Capital Expenditure Grant (CAPEX) Scheme and a Public Service Obligation (PSO) air services Scheme.  The Government decided last December to continue supports to the four regional airports under those three Schemes. Budget 2015 maintains those supports.  

Following the December Government Decision, my Department prepared a new Regional Airports Programme for the period 2015-2019, which also reflects the terms of the 2014 EU Guidelines on State Aid to airports and airlines, along with the recommendations of the IWAK Study Group. That draft Programme has been submitted to the EU Commission for its consideration and approval. Following its approval, my Department will move to identify the specific supports that will be available to each of the four regional airports, including IWAK, over the life of the Programme.  The draft Programme envisages funding also being obtained by the airports to facilitate their future development from local authorities and local business interests.
