Ceisteanna (244)

Dara Calleary

Ceist:

244. Deputy Dara Calleary asked the Minister for Justice and Equality when he plans to legislate for the full implementation of the Law Reform Commission report, LR67/2002, and in particular the proposals with regard to leasehold land or property; and if he will make a statement on the matter. As I indicated in my response to the Deputy's parliamentary question of 11 September on the same issue, the Law Reform Commission had intended to progress statutory codification in the area of adverse possession taking into account earlier recommendations, including those relating to leasehold land or property, contained in the LRC Report 67-2002.

It appears that the Commission has not been in a position to advance its work on this complex area of land law due to other more pressing law reform priorities.  Pending receipt of reform proposals in relation to adverse possession, I have no immediate plans to bring forward proposals for legislative change in this area.  However, the operation of existing legislation is kept under general review by my Department.
