69. Deputy Alan Kelly asked the Minister for Education and Skills the reason four members of the Higher Education Authority who are not ordinarily resident in the State have remained as members of the authority despite section 9 of the Schedule to the Higher Education Authority Act 1971 stating that such persons shall be disqualified from holding and shall cease to hold office in circumstances in which they cease to be ordinarily resident in the State. As I set out in my reply to the Deputy’s question on this matter in Question No. 27933 on 29 September 2016, the current members of the Board of the Higher Education Authority have been appointed in line with the terms of the Higher Education Authority Act, 1971 and it should be noted that the legislation does not state that in order to be appointed to the Board a member must be ordinarily resident in the State.
