148. Deputy Mick Barry asked the Taoiseach and Minister for Defence the legislative and procedural changes he plans to introduce to settle outstanding grievances with the Defence Forces representative organisations in view of the breach of the European Charter of Fundamental Human Rights (details supplied). Members of the Defence Forces have access to a range of mechanisms for dispute resolution. They are designed to ensure that independence, confidentiality and impartiality are properly respected. Claims can be advanced on either an individual or collective basis, depending on the forum being used. The outcome arising from the use of a particular mechanism may determine the type of legislative or procedural change required. In addition, the Minister has power pursuant to Section 26 Defence Act 1954 to make Regulations.

As there here has been no finding of a breach of the EU Charter of Fundamental Human Rights, no legislative or procedural change is anticipated in reference thereto.
