Deputy Catherine Murphy asked the Minister for Housing, Planning and Local Government if a ministerial order under section 160 that an environmental impact assessment which would be mandatory under the codified EIA Directive 2011/92/EU is not required in view of the European Court of Justice judgment in Case C-215/06 (details supplied); and if he will make a statement on the matter. Section 160 of the Planning and Development Act 2000, as amended (the Act), relating to unauthorised development, does not provide for a ministerial order in relation to environmental impact assessment. Section 30 of the Act specifically precludes the Minister from exercising any power or control in relation to any particular case with which a planning authority or An Bord Pleanála is or may be concerned.
