Amharc ar fhreagraInformation on projected enrolments in 6th class (mainstream classes only) for the years 2018 - 2023 is available in the table below. It can be seen that 6th class enrolments are due to rise by more than 8,000 pupils between the latest actual figures available - 63,037 in 2017/2018 - and the peak in 2020/2021 (71,466) before beginning to reduce as the demographic peak moves through the education system.

Ireland's particular demographic make-up, with peaks in births in 1980 (74,064) and again 30 years later in 2009 (75,554), and a low point in 1994 with just 48,255 births, has led to large fluctuations in demand across all sectors of education from primary to post-primary to third level and these fluctuations are reflected in projected enrolments.

208. Deputy Niall Collins asked the Minister for Education and Skills if he has been in contact with a school (details supplied); if his attention has been drawn to the concern of the local community in respect of the matter; and if he will make a statement on the matter. [52036/18]
Amharc ar fhreagraWhen work commenced on the site referred to by the Deputy, concerns were raised by local residents regarding noise from outside of working hours. The building contract and the planning conditions allow for works on site between the hours of 7am - 7pm.
Following discussions with South Dublin County Council (SDCC), the Contractor amended work practices to ensure no works were taking place after 7pm.
Local residents then raised concerns that works were commencing before 7am. The Contractor strongly refuted this. Following these complaints the contractor installed 24hr CCTV monitoring and ensured that the main gates to the site were not opened before 7am. Following further complaints by some residents that works were happening in advance of 7am, the Contractor shared CCTV footage with SDCC which confirmed that there was no access to the site in advance of 7am.
The Contractor is continuing to monitor the situation and is actively liaising with SDCC as appropriate.

Amharc ar fhreagraMar is eol don teachta, d'fhógair mo Roinnse pleananna le déanaí chun 42 scoil nua a bhunú sna ceithre bliana seo amach romhainn (2019-2022).
Nuair a chinntear go bhfuil gá le scoil nua chun freastal ar riachtanais dhéimeagrafacha i gceantar, reáchtálann mo Roinnse próiseas pátrúnachta ar leith chun a shocrú cé a fheidhmeoidh an scoil. Tá teanga theagaisc na scoile atá beartaithe mar dhlúthchuid den phróiseas measúnaithe agus molta a bhaineann leis an bpátrúnacht. Tá sé de rogha ag gach comhlacht pátrúnachta, lena n-áirítear pátrúin atá bainteach le soláthar trí mheán na Gaeilge agus go deimhin aon phatrún ionchasach ar mian leis oideachas trí mheán na Gaeilge a sholáthar, cur isteach ar phátrúnacht scoile nua faoin bpróiseas pátrúnachta. Tá roghanna tuismitheoireachta maidir le gach pátrún agus seachas sin maidir le teanga theagaisc na scoile, ó thuismitheoirí na leanaí atá ina gcónaí sa cheantar pleanála scoile atá i gceist, chomh maith leis an méid éagsúlachta atá ar fáil faoi láthair sna ceantair sin, thar a bheith tábhachtach i dtaca leis na cinntí a dhéantar maidir le toradh an phróisis sin. Tá anailís ar an méid éagsúlachta, lena n-áirítear teanga, atá ar fáil cheana féin i gceantar agus sna ceantair phleanála scoile in aice láimhe, san áireamh sa phróiseas measúnaithe.
Déanann grúpa comhairliúcháin seachtrach neamhspleách, An Grúpa um Bunú Scoileanna Nua (NSEG), maoirseacht ar an bpróiseas pátrúnachta. Tar éis dóibh tuarascálacha measúnaithe mo Roinne a bhreithniú, cuireann an NSEG tuarascáil mar aon le moltaí faoi mo bhráid lena breithniú agus an cinneadh deiridh a dhéanamh ina taobh. Cuirtear na tuarascálacha measúnaithe agus moltaí an NSEG i dtaca le gach próiseas pátrúnachta den sórt sin ar fáil ar shuíomh gréasáin mo Roinne.
Maidir leis an bpróiseas pátrúnachta don 12 bhunscoil nua atá le bunú in 2019, tá leibhéal rogha na tuismitheoireachta don teanga theagaisc (Gaeilge nó Béarla) le deimhniú fós. D'oscail an gCóras Próiseála Pátrúnachta ar Líne (OPPS) do thuismitheoirí leanaí atá ina gcónaí sna ceantair phleanála scoile ábhartha maidin inné, ag tabhairt deis do tuismitheoirí a rogha a léiriú i dtaca le Béarla nó Gaeilge mar theanga theagaisc sna scoileanna sin chomh maith lena rogha maidir le pátrúnacht na scoileanna. Chomh maith le roghanna tuismitheoireachta, cuirtear san áireamh freisin méid na héagsúlachta (maidir le héiteas agus teanga theagaisc) atá ar fáil cheana féin sa cheantar sna cinntí maidir le torthaí próisis pátrúnachta.
Sa tuarascáil a chuir siad faoi mo bhráid i mí Dheireadh Fómhair, luaigh an NSEG na hathruithe dearfacha atá corpraithe ag mo Roinnse cheana féin sa phróiseas measúnaithe, amhail roghanna faoi leith a chuirtear ar fáil do thuismitheoirí maidir le teanga theagaisc. Mhol an Grúpa freisin go ndéanfadh mo Roinnse an cheist chasta seo a iniúchadh tuilleadh i gcomhairle leis an príomhchomhlachtaí pátrúnachta. I dtaca leis sin, tá bealaí ina bhféadfaí tuilleadh léirithe a dhéanamh ar roghanna tuismitheoireachta maidir le hoideachas trí mheán na Gaeilge i bpróisis phátrúnachta amach anseo, á n-iniúchadh ag mo Roinnse faoi láthair. Tógfaidh sé roinnt ama an cheist sin a iniúchadh go hiomlán, lena n-áirítear dul i gcomhairle leis na príomhchomhlachtaí pátrúnachta, agus léirigh mo Roinnse an méid sin ina comhfhreagras leis an gCoimisinéir Teanga i mí Aibreáin 2018.

The Department publishes information on second level retention rates by cohort - the latest information available is for the cohort of pupils who entered second level education in 2011 and were due to complete the Leaving Certificate in June of 2016 or 2017, depending on whether they completed Transition Year.

215. Deputy Thomas P. Broughan asked the Minister for Education and Skills the status of the review of out-of-school education provision; and if he will make a statement on the matter. [52161/18]
Amharc ar fhreagraAs the Deputy is aware, Action 88 of DEIS Plan 2017 provides for a review of current out of school education provision. This review has been carried out by a Working Group chaired by my Department and including representatives from Tusla and the ETB sector. This review has been informed through the use of questionnaires, submissions from stakeholders and a public consultation process, including consultation with students. A report is being finalised by the working group.

Broughan asked the Minister for Education and Skills the details of public bodies and entities under the aegis of his Department for which he is responsible for making all or some appointments to which are not subject to the guidelines on appointments to State boards in that the recruitment and selection process is undertaken by his Department and not through the Public Appointments Service; and if he will make a statement on the matter. In line with the guidance developed by the Department of Public Expenditure and Reform the process for filling vacancies on the Department's aegis body State Boards, where I, as Minister, have discretion to make the appointments, is generally managed by the Public Appointments Service (PAS). Applications are made through the dedicated website www.Stateboards.ie. An assessment process is undertaken by PAS leading to the creation of a list of candidates suitable for appointments to Boards.
The Deputy should note that individuals may be nominated for board appointments by various organisations arising from the terms of the relevant Statutes of the Body concerned and, accordingly, board appointments, while made by me, are not in all cases made at my discretion.

Deputy Róisín Shortall asked the Minister for Education and Skills his plans to open a new, permanent, non- or multi-denominational co-educational secondary school serving children in an area (details supplied) in view of the fact that there is currently no co-educational secondary school catchment area and the newly located college will operate temporarily without a fixed catchment area. Amharc ar fhreagraIn order to plan for school provision and analyse the relevant demographic data, my Department divides the country into 314 school planning areas and uses a Geographical Information System, using data from a range of sources, to identify where the pressure for school places across the country will arise. With this information, my Department carries out nationwide demographic exercises to determine where additional school accommodation is needed at primary and post-primary level.
As the Deputy will be aware, the Government recently announced plans for the establishment of 42 new schools over the next four years (2019 to 2022). The 4-year horizon will enable increased lead-in times for planning and delivery of the necessary infrastructure.
A patronage process is run after it has been decided, based on demographic analysis, that a new school is required. This patronage process is open to all patron bodies and prospective patrons. Parental preferences for each patron, from parents of children who reside in the school planning areas concerned, together with the extent of diversity currently available in these areas, are key to decisions in relation to the outcome of this process.
In addition to the new schools announced, there will be a need for further school accommodation in other areas in the future. Based on the current analysis, this need can be addressed through either planned capacity increases in existing schools or additional accommodation or extensions to existing schools. Approximately 40% of extra school places are delivered by extending existing schools.
The requirement for new schools will be kept under on-going review and in particular would have regard for the increased roll-out of housing provision as outlined in Project Ireland 2040.
As the Deputy may be aware, a new 1,000-place post-primary school was established in September 2017 to serve the Carpenterstown_D15 and Castleknock_D15 school planning areas as a regional solution.
All new schools established since 2011 to meet demographic demand are required to prioritise pupil applications from within the designated school planning area(s) which the school was established to serve. This does not preclude schools from enrolling pupils from outside of the designated school planning area, rather it reflects the need to accommodate in the first instance the demographic for which the school was established.
It is the responsibility of the managerial authorities of all schools to implement an enrolment policy in accordance with the Education Act, 1998. In schools where there are more applicants than places available a selection process may be necessary. In this regard a Board of Management may find it necessary to prioritise enrolment of children from particular areas or particular age groups or on the basis of some other criterion. For example, some schools give priority to applicants who have attended a particular primary school (known as a feeder school). The criteria to be applied by schools in such circumstances are a matter for the schools themselves. This selection process and the enrolment policy on which it is based must be non-discriminatory and must be applied fairly in respect of all applicants. However, it may result in some pupils not obtaining a place in their school of first choice.

On Monday 3 December 2018 my Department was informed of the closure of the school referred to by the Deputy. This school, which was a private English language school, is a member of MEI (Marketing English in Ireland), an association of English language schools. I understand that MEI representatives met with the school’s management and affected students on 3rd December 2018 and are continuing to liaise with all relevant parties. MEI are putting the necessary arrangements in place to ensure that students affected by the school's closure will be able to complete the course for which they have enrolled, or a similar course, at another MEI member school. My colleague Minister Mitchell O’Connor and I have also separately met with some of the affected teachers.
The Deputy may be aware that legislation is currently being progressed through the Oireachtas which is intended to substantially strengthen regulation in the English language education sector. Committee Stage of the Qualifications and Quality Assurance (Education and Training) (Amendment) Bill was initiated on 5th December 2018.
This new Bill will establish the International Education Mark (IEM) and a Protection for Enrolled Learners (PEL) Fund. The IEM is a core component of the Government's policy for the English language sector and will provide a full quality framework for the provision of education to international learners in the future. Only those providers who meet the robust quality assurance procedures of Quality and Qualifications Ireland (QQI) will be allowed to carry the Mark.
Once fully implemented, providers must gain authorisation from QQI to use the IEM in order to be eligible to recruit international students. The IEM is a tool to further enhance and sustain the quality of our education system. It also provides learners, or potential learners, with the necessary confidence that providers with the IEM have been quality assured by QQI.
The Bill also contains provisions to provide QQI with additional statutory powers to examine a provider’s financial sustainability and to evaluate a provider’s corporate fitness. These provisions will enable QQI to examine the bona fides of a provider in addition to assessing that the provider has the capacity and capability to implement the quality assurance processes and provide programmes of education and training consistent with the requirements of the Act. All providers, including English language providers, will have to satisfy QQI in relation to issues such as the legal personality, ownership and corporate governance arrangements in addition to examining that adequate financial resources are in place to ensure the viability of these businesses.
Upon enactment, the Bill will also empower QQI to establish a fund for the protection of enrolled learners (PEL). This fund will be resourced by an annual charge from those providers covered by it. The fund will be used to ‘teach out’ a programme in the event that a provider fails to provide a programme. Should this not be possible, the fund will be used to reimburse students for the most recent fees that have been paid.
At Committee Stage reading of the Bill Minister Mitchell O’Connor announced her intention to appoint an experienced mediator to meet with bodies representing employers and employees in the English language education sector to explore the potential for a Registered Employment Agreement to be developed for workers in the English language sector. This will complement the provisions contained in the Qualifications and Quality Assurance (Amendment) Bill that are intended to strengthen QQI’s role as a regulator of quality in the English language training sector.

As the Deputy will appreciate, the Garda Commissioner is responsible for managing and controlling generally the administration and business of An Garda Síochána as well as for decisions in relation to the allocation and management of Garda equipment and resources, including in relation to ICT, in light of his identified operational demands. As Minister, I have no direct role in these matters.
I have asked the Garda Commissioner for the specific information requested and when it is to hand, I will write directly to the Deputy.
221. Deputy Niamh Smyth asked the Minister for Justice and Equality the status of a visa application by a person (details supplied); and if he will make a statement on the matter. [51549/18]
Amharc ar fhreagraI have been advised by the Irish Naturalisation and Immigration Service (INIS) of my Department that the visa application referred to was granted, under delegated sanction, by the Irish Embassy in Singapore on 10 December 2018. The applicant will be notified directly and may contact the Embassy to arrange collection of their passport and visa.
Queries in relation to the status of individual immigration cases may be made directly to INIS by e-mail using the Oireachtas Mail facility which has been specifically established for this purpose. This service enables up to date information on such cases to be obtained without the need to seek information by way of the Parliamentary Questions process. The Deputy may consider using the e-mail service except in cases where the response from INIS is, in the Deputy’s view, inadequate or too long awaited. In addition, applicants may themselves e-mail queries directly to INIS (visamail@justice.ie).
222. Deputy Clare Daly asked the Minister for Justice and Equality if the Office of Public Works advised his Department against the purchase of the Thornton Hall site on the basis that the site was unsuitable for the construction of a prison prior to the sale going ahead in 2005. [51556/18]
Amharc ar fhreagraIn February 2004, the Government gave approval for the then Minister for Justice and Equality to replace the facilities at the Mountjoy Prison complex with a new prison facility on a greenfield site. This development was to address the lack of capacity in the prison system and substantial operational challenges in the Mountjoy complex. On 11 February 2004 advertisements looking for suitable sites were published. In May 2004, a site selection committee was established to review potential sites. This selection committee, which included an OPW nominee, recommended the purchase of the site at Thornton Hall. The minutes of the committee's deliberations were subsequently published on my Department's website.
There is already extensive background information in the public domain on the Thornton Hall purchase - how it arose, the related prison accommodation issues and other relevant factors. In particular, the Deputy may recall the Comptroller & Auditor General Annual Report 2005 which addressed this issue as well as the subsequent examination by the Public Accounts Committee in October 2006. The Comptroller & Auditor General also addressed this issue as part of the Report on the Accounts of the Public Services in 2014 (No. 9 Development of Prison Accommodation in Dublin) and the Public Accounts Committee subsequently examined this issue in November 2015.
It is worth recalling, in summary, that due to the downturn in the economy, the scale of the project could not be accommodated within the capital allocation available. In light of the decision not to proceed with Thornton Hall, significant capital investment has been made at the Mountjoy campus over recent years.
223. Deputy Paul Kehoe asked the Minister for Justice and Equality if a dialogue has commenced in regard to matters (details supplied); and if he will make a statement on the matter. [51570/18]
Amharc ar fhreagraAs the Deputy will be aware, the Transfer of Sentenced Persons Acts 1995 to 1997 give effect to the Convention on the Transfer of Sentenced Persons 1983. The Deputy will also be aware that there have been a number of recent Court judgements which have implications for transferring prisoners from other States to Ireland.
In particular, in the Court of Appeal decision in the case of M.McK v The Minister for Justice and Equality [2016] IEHC 208, the judgement directed that the Minister must consider each application on its own merits under the existing legislation and give detailed reasoning for the decision reached. Thus, each application is being considered on its own merits. I cannot prejudge the outcome of any such application. All relevant applicants have been informed of this and will be further informed of any developments in their respective cases as they arise.
Officials from my Department are in regular contact with the Irish Prison Service regarding the operation of the Transfer of Sentenced Persons Acts, 1995 and 1997.
224. Deputy Catherine Murphy asked the Minister for Justice and Equality if his attention has been drawn to instances in which professional visits have been recorded by members of staff in the Irish Prison Service; and if he will make a statement on the matter. [51575/18]
Amharc ar fhreagraI have asked the Inspector of Prisons, Patricia Gilheaney, to carry out an investigation into recent allegations of surveillance and other wrongdoing in prisons to determine as far as possible the facts.
It should be noted that section 31(7) of the Prisons Act 2007 provides that Governors, other prison officers and other persons employed in prisons shall, as far as reasonably practicable, comply with any request for information that the Inspector may make in the performance of her functions, which include the function of carrying out an investigation under subsection (2). In addition, the acting Director General of the Prison Service made clear that the Prison Service will co-operate fully with the investigation by the Inspector of Prisons. The Inspector of Prisons will therefore have full access to relevant documentation and personnel in Prison Service Headquarters or elsewhere in the Prison Service in her investigation.
An Garda Síochána are also examining the allegations and I understand they will coordinate, if needed, with the Inspector in relation to her investigation.
The report of the Inspector of Prisons, when finalised, will provide a basis for consideration of what further steps may need to be taken.
