43. Deputy Thomas P. Broughan asked the Minister for Transport, Tourism and Sport the response of his Department to the decisions in cases (details supplied) to find section 44(10) of the Road Traffic Act 2010 as amended by the Road Traffic Act 2016 incompatible with the Constitution; and if he will make a statement on the matter. While the substance of this judgment was made clear in advance by the judge, the formal judgment on was issued only on 19 November.  I am taking legal advice and will analyse the implications carefully before deciding on an appropriate response.
