909. Deputy Eoin Ó Broin asked the Minister for Justice her views on whether it is appropriate for a prison (details supplied) to investigate an incident of complaint in cases in which an investigation has been conducted and a decision has already been provided by the Irish Prison Service. I am advised by my officials in the Irish Prison Service that the complaint referred to by the Deputy was made by a prisoner under Rule 57(b) of the Prison Rules 2007.

The complaint was investigated by an external Serious Complaints Investigator and the investigation report was provided to the Governor for his findings and decision.

In accordance with Rule 57B (6) an investigation carried out on foot of a Prisoner Complaint does not constrain a Governor from initiating another investigation under the Prison (Disciplinary Code For Officers) Rules, 1996.
