343. Deputy Paul McAuliffe asked the Minister for Housing, Local Government and Heritage the advice to local authorities in relation to the invasive species Japanese Knotweed on derelict private property; if councils have a role in controlling the invasive species on private property and or the powers that exist to intervene on a matter in the case of derelict properties; and if he will make a statement on the matter. Invasive alien species legislation is contained within the Wildlife Acts and the European Communities (Birds & Natural Habitats) Regulations, SI 477 of 2011.

Legal responsibility for the eradication, containment or management of invasive alien species resides with the landowner.

Under the Derelict Sites Act 1990, local authorities are responsible for dealing with derelict sites in their area.
