Deputy Richard Boyd Barrett asked the Minister for Social Protection what happens to non-binary gender recognition on legal documents in Ireland if individuals have been legally recognised as non-binary and received an appropriate gender marker on other EU legal documents, such as passports; and if he will make a statement on the matter. The Gender Recognition Act 2015 sets out the process behind the legal recognition of a change in gender from "male" to "female" or from "female" to "male" genders only.

The recognition of a document containing a non-binary marker from another EU state is a matter to be determined by the department, or body, that a person holding such a document interacts with.

I trust this clarifies the matter for the Deputy.
