On Tuesday 17 December the Joint Committee on Business, Enterprise and Innovation was granted the power to send for persons, papers and records by Dáil and Seanad Éireann. This completes the first step in a process that will, the Committee hopes, permit it to compel Mr. Ian Drennan, Director of Corporate Enforcement, to provide it with a submission in relation to the case of the DPP V Seán FitzPatrick.
Under the Houses of the Oireachtas (Inquiries, Privileges and Procedures) Act 2013 it is now a matter for the Dáil Committee on Procedure and the Seanad Committee on Procedure and Privileges to grant the Committee consent to compel the Director of Corporate Enforcement to produce the submission using powers similar to those used in the course of the Banking Inquiry.
Commenting on this development, Committee Chair, Mary Butler T.D., said “The decisions of the Dáil and Seanad are welcome. Acquiring the Director’s submission may be fundamental to the Committee’s effective oversight of the ODCE and would enable us to establish the extent to which the submission is relevant to our pre-legislative scrutiny of the Companies (Corporate Enforcement Authority) Bill 2018“.
