Question:

76 Mr. Sherlock asked the Minister for Finance if he intends to amend the Central Bank Act, 1989 to ensure that the bank is obliged to provide all relevant information to an inspector appointed under the Companies Act, 1990, in view of the recommendations of the interim report of the inspector appointed to investigate a number of companies involved in Sugar Distributors; and if he will make a statement on the matter.

The Central Bank is required by the existing legislation not to disclose information on specific transactions. Consequently, it could not provide directly the information sought by the inspector. However, by virtue of section 16 — 2(c) of the Central Bank Act, 1989, this information was available to the Minister for Finance who transmitted it through the Minister for Industry and Commerce to the inspector, on the basis that it was in the public interest to do so. Accordingly I do not see a need to amend the Central Bank Act in that regard.
