Question:

438 Mr. Leyden asked the Minister for Social Welfare if he will approve payment of unemployment assistance to a person (details supplied) in County Roscommon.

The application from the person concerned was refused on the basis that his means, derived from self-employment and capital, exceeded the statutory limit. He appealed this decision to the independent social welfare appeals office on the grounds that he was no longer self-employed and had no means of support.

The case was listed for oral hearing on 19 November 1991. However, the person concerned did not attend this hearing and the appeals officer, on the basis of the evidence available to him, upheld the decision of the deciding officer in the matter.

In January 1992 the person concerned telephoned the social welfare appeals office and indicated that he had not received notification of the hearing. A further hearing was arranged from 18 February 1992 but it subsequently came to light that he had changed address. The appeal has been relisted for an oral hearing on 10 April 1992.
