Question:

109 Mr. Costello asked the Minister for Justice if the gardaí have reopened the investigation into a rape case and alleged miscarriage of justice involving a British citizen in the Irish Republic as reported in a Northern Ireland newspaper (details supplied): if she will report on the progress of the investigation; when she expects a final report; and if she will make a statement on the matter. The Deputy was previously informed by my predecessor in response to a parliamentary question answered on 12 April, 1994, that a file in this matter was referred to the Director of Public Prosecutions who decided that a prosecution was not warranted.

As regards the present status of the case, I have requested a detailed report from the Garda authorities in the matter and I will write directly to the Deputy once this report is available.
