115 Mr. Browne (Wexford) asked the Minister for Agriculture and Food the reason a penalty was imposed on a person (details supplied) in County Wexford in relation to suckler cow payments; and if the matter will be reinvestigated. [23991/98]

An application was made by the person named under the suckler cow premium scheme in respect of 13 animals on 22 May 1998. At an on farm inspection on 5 October it was found that the applicant applied on an animal which was not in his ownership and possession at the time of application. The applicant was informed that this was contrary to the terms and conditions of the suckler cow premium scheme. The notification letter offered the person named the opportunity to appeal the case and provide documentation to support the appeal. No such appeal was received. However the case will now be reviewed based on the information available.
