Question:

285 Ms O. Mitchell asked the Minister for Justice, Equality and Law Reform the reason the Carriage Office is informing hackney drivers with older cars that before being passed out they must have a national car test and when they present for a national car test they are informed that they are only permitted to test private cars; and if he will rectify this situation with the utmost urgency. [2501/00]

I am informed by the Garda authorities that the Road Traffic (National Car Test) Regulations, 1999, as made by the Minister for the Environment and Local Government, exempt a vehicle which is a small public service vehicle from the provisions of the Road Traffic (National Car Test) Regulations, 1999.

I have also been informed by the Garda authorities that some confusion arose because some applicants were mistakenly advised by the Garda that their vehicles need to pass the NCT prior to having their licence issued. I have now been assured by the Garda authorities that they have rectified this error and they regret that it occurred.
