112 Mr. McGinley asked the Minister for Agriculture, Food and Rural Development when cattle and sheep headage payments will issue to a person (details supplied) in County Donegal. [5632/00]
The person named claimed a total of 19.54 hectares on his 1999 area aid application. Following processing of his application an area of 13.80 hectares was determined. This represents a difference of 5.74 hectares or 42% between the area claimed and that determined.
Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%, the penalty is based on double the difference when it is between 3% and 20% and when the difference is over 20%, a 100% penalty must be applied.
Therefore in this case as the overclaim is greater than 20%, no area aid related payments can issue.
113 Mr. Penrose asked the Minister for Agriculture, Food and Rural Development if he will ensure that a person (details supplied) in County Westmeath who made an application for additional suckler cow quota receives this in view of the fact as he is a full-time farmer whose income is highly dependent on this quota; and if he will make a statement on the matter. The person named has applied for an allocation of suckler cow quota from the year 2000 national reserve. He applied under category D which is reserved for farmers who do not qualify under the priority categories A, B or C. More than 7,200 farmers have applied for reserve quota and their applications are being examined. It is not possible to say at this stage, what the result of any individual application will be. It is envisaged that all applicants will be notified, by the end of February at the latest, of the result of their applications.
Reserve quota will be allocated, inter alia, with reference to each applicant's livestock units. Livestock units are determined with reference to the number of animals claimed on under the ewe premium scheme, suckler cow premium scheme and special beef premium scheme in 1999, together with the livestock unit equivalent of any milk quota held on 1 April 1999.
