81 Mr. N. Ahern asked the Minister for the Environment and Local Government the regulations for house extensions and garages which are within the exemption size and do not require planning permission; the other requirements, if any, on a householder before proceeding with construction in relation to notification, registration, approval, by-laws, certification by authorised person or any other requirement; and if he will make a statement on the matter. The Local Government (Planning and Development) Regulations, 1994 exempt certain classes of development within the curtilage of a dwelling house, including house extensions and garages, and subject to certain conditions and limitations, from the requirement to obtain planning permission. The conditions and limitations, including conditions in relation to height siting and a maximum area of 23 square metres, applying to domestic extensions are contained in class 1 of part I of the second schedule of the Regulations. If an extension complies with these requirements, it does not need planning permission. A copy of an information leaflet on the main planning issues when carrying out work around the house will be forwarded to the Deputy.

The building regulations (S.I. 497 of 1997) apply to the design and construction of new houses and to extensions to existing houses with the exception of, for example, domestic garages and conservatories, subject to such works meeting certain conditions and where they are less than 25 square metres.

If development is exempted under the planning Acts it is exempted from the requirement to submit a commencement notice to the local building control authority, provided that such works do not require a fire safety certificate. Such a certificate is not required for new houses and house extensions. An information leaflet on the building control system will also be forwarded to the Deputy.
