Written Answers. - Importation of Firearms.

212 Mr. Currie asked the Minister for Justice, Equality and Law Reform if his attention has been drawn to the importation from Spain, Italy and other European countries of replica hand guns which fire pellets; if his attention has further been drawn to the fact that these weapons have caused injury and may have been used in criminal activity; if he has satisfied himself that there is legislation to prevent importation and also to allow for the seizure of these weapons; and if he will make a statement on the matter. I presume the Deputy is referring to air pistols which are capable of firing pellets.

Air pistols are classed as firearms under the Firearms Acts, 1925 to 2000. The position in relation to the importation and possession of air pistols is, therefore, the same as with other firearms.

A firearm or ammunition may not be imported into the State without an importation licence issued by my Department. In addition, a person may not be in possession of a firearm or ammunition without a firearm certificate granted under the firearms legislation. Furthermore, it is the policy not to grant importation licences or firearm certificates for handguns. Any person who contravenes these provisions is guilty of an offence and is liable to the penalties provided under the legislation.

I have been informed by the Garda authorities that a number of air pistols were purchased by students while on holiday abroad last year. These weapons were seized by the Garda.

The Garda authorities have also informed me that they are aware of various incidents involving young people and air pistols where persons have been injured. Appropriate action was taken when the incidents were brought to their attention. The Garda authorities have advised schools of the dangers associated with air pistols and have requested that they should be informed of any related incidents.

In addition, travel agents have also been made aware of the legislation relating to the importation of these weapons as have post offices as occasionally these weapons are illegally imported by mail order.

The Garda authorities are not aware of these weapons being used in criminal activities.

I am satisfied that the firearms legislation makes adequate provision for the seizure of any firearm which is unlawfully imported by any person or which is in the unlawful possession of any person.
