Question:

144 Mr. Creed asked the Minister for Agriculture, Food and Rural Development the situation regarding payment of 2000 area aid to a per son (details supplied) in County Cork; the reason for the inaccuracies included in his area aid application, which was completed by Teagasc; and the financial consequences of these inaccuracies in the context of cattle headage grants. [29530/00]

The person named submitted a 2000 area aid application on which he declared a total of 8.59 hectares made up of three plots. This information was entered on to the Department's electronic database.

An overclaim of 0.56 hectares, 6.51%, was identified on one of the land parcels claimed by the person named. The person was informed of the position and submitted correspondence indicating that he accepted the overclaim.

Under article 9 of EU Regulation 3887/92, a penalty of twice the percentage overclaim is applied when the overclaim is between 3% and 20%.

Therefore in this case the percentage penalty applied is 13.03%, resulting in an accepted area of 6.91 hectares. This area is comprised of 3.08 hectares of disadvantaged land and 3.83 hectares of non-disadvantaged land, and his cattle headage grant based on the adjusted area is £276.03. The cattle headage grant, based on the 8.03 hectares found would be £314.44.
