390 Mr. McDowell asked the Minister for the Environment and Local Government if section 132 of the Local Government Act, 2001, has been commenced; and, if not, if he will give a timescale for the commencement of this section. [24272/01]

The provisions of the Local Government Act, 2001, will be brought into operation on a phased basis by way of a series of commencement orders as necessary preparations are completed. The first commencement order was made last week and laid before both Houses. It is the intention that the next order will be made towards the end of the year and will bring major portions of the Act, including section 132, into operation from 1 January 2002. Local authorities have been notified of the position.
