Question:

188 Mr. R. Bruton asked the Minister for Justice, Equality and Law Reform if EU non- nationals are obliged to make a statement of their health condition or to undergo tests or treatments when applying for temporary residence here. [27198/01]

I presume the Deputy's question refers to non-EU nationals. Although Article 5(2)(f2>c) of the Aliens Order, 1946, as amended provides that an immigration officer may refuse leave to land to an alien where that person suffers from a disease or disability specified in the fifth schedule to the order, persons are not routinely requested to make a statement of their health condition or to undergo tests or treatments when applying for permission to remain in the State.
