I propose to take Questions 75 and 101 together.
Public procurement regulations are a matter for the Minister for Finance. I understand that, under current public procurement rules, public bodies are required to publish information on successful candidates for public contracts in the Official Journal of the European Union, including the names of candidates.
Under existing company law, information concerning ownership of a company or other corporate entity, including the identity of directors, and which is maintained by the Registrar of Companies, is public information and is available from the Companies Registration Office.
Section 14 of the Companies Act 1990, as amended by the Company Law Enforcement Act, 2001, provides that the Director of Corporate Enforcement may, if he judges it appropriate and subject to certain conditions, appoint one or more competent inspectors to investigate and report on the membership of any company and otherwise with respect to the company for the purpose of determining the true persons who are or have been financially interested in the success or failure, real or apparent, of the company or able to control or materially influence the policy of the company.
I have no plans to reform the aforementioned company law provisions.
