395 Mr. Penrose asked the Minister for Justice, Equality and Law Reform if there has been any change on the rule or the requirement that, in order to obtain compensation under the Garda Síochána (Compensation) Acts, 1941 and 1945, the application has to prove malice; and if he will make a statement on the matter. [5820/02]

The Garda Síochána (Compensation) Acts, 1941 and 1945, apply where a member of the Garda Síochána dies from injuries maliciously inflicted or where personal injuries are maliciously inflicted on a member.

The provisions relating to the deaths and injuries resulting from malicious assaults are set out in Section 2 of the Garda Síochána (Compensation) Act, 1941. There have been no changes in these provisions.
