488 Mr. Haughey asked the Minister for Justice, Equality and Law Reform the position regarding an application by a person (details supplied) in Dublin 3 for an appropriate visa; the legal situation in relation to this person's status at this time; if this person is obliged to leave here and return again; the length of time it will take to process this new application; and if he will make a statement on the matter. [7632/02]

The person in question has applied for permission to remain in the State on the basis that she is residing here with her EU national spouse.

On 28 February my Department wrote to the applicant requesting supporting documentation in order to process her application. Upon its receipt the application will be considered further. My Department has also advised the applicant that it will not be necessary for her to leave the State while her application is being processed.
