172 Mr. Stagg asked the Minister for Transport the various remedies available to local authorities under the Road Acts to financially penalise individuals who cause serious damage to road surfaces, including near destruction, to enable local authorities to claim full reinstatement cost from the individuals concerned; and if he will make a statement on the matter. I refer the Deputy in particular to sections 13, 76 and 81 of the Roads Act, 1993.

With regard to road openings by statutory undertakers, I would refer the Deputy to the reply to Question No. 1226 of 9 October 2002.
