Question:

233 Mr. Costello asked the Minister for Justice, Equality and Law Reform the reason no action has been taken by the gardaí in response to numerous complaints regarding intimidation and harassment, trespass and threats of violence against a person (details supplied) in Dublin 15; and if he will make a statement on the matter. [13150/03]

I am informed by the Garda authorities that between 12 February 2001 and 28 April 2003, four incidents of criminal damage and public order offences were reported to them by the person referred to by the Deputy. I understand that, on each of these occasions, gardaí called to the complainant and that investigations into his complaints have been actively pursued.

I am further informed that, on two occasions, no witnesses were available to assist the investigating garda. On the third occasion, gardaí brought the complainant around the area in an attempt to identify the culprits. On the fourth occasion, video tape evidence of the alleged culprit was handed to investigating gardaí who are endeavouring to establish the identity of the individual in question.
Finally, I am informed that the complainant is kept informed by investigating gardaí on a regular basis of developments.

Question:

234 Dr. Upton asked the Minister for Justice, Equality and Law Reform the steps available to people living in an area (details supplied) in Dublin 8 where there is an ongoing problem with a local off-licence which is attracting street drinkers and anti-social behaviour. [13190/03]

I am informed by the Garda authorities that the off-licence is situated on a busy street which is regularly patrolled by different units from Kevin Street Garda station. I am also informed that members of the local community objected at the annual licensing court to the renewal of the off-licence, but their objection was dismissed due to procedural difficulties.

The local gardaí are satisfied that the licensee is conducting his business in a responsible manner. They will continue to patrol the area and monitor the situation and have assured me of their best support at all times for the local community.
