Question:

204 Mr. Hayes asked the Minister for Agriculture and Food when payment of all grants under the 2002 special beef premium scheme will issue to a person (details supplied) in County Tipperary. [22862/03]

The person named submitted three applications in respect of a total of 77 animals for special beef premium in 2002 as follows: application dated 6 February 2002 in respect of 31 animals; application dated 18 April 2002 in respect of 11 animals; application dated 31/12/2002 in respect of 35 animals.

The person named qualified for slaughter premium under the 2002 scheme in respect of 40 animals.

The reduction in payment to the person named arose for the following reasons. Four animals on the December 2002 application were deleted from the application as no cattle passports were available for these animals. A further four animals on the December application were rejected for payment due to non-compliance with the cattle movement monitoring system (CMMS) notifications resulting in a consequential penalty of 3.66% across all bovine schemes (special beef and slaughter). A reduction of 12.5% applicable to all applicants who applied on in excess of 50 animals in 2002 due to the overshoot of the national quota for special beef premium.

This case was appealed to the agriculture appeals office who upheld the Department's decision.

All payments due have been paid to the person named.
