Deputy Ivana Bacik asked the Minister for Justice if she will make a statement on the appropriateness of responsibility for the regulation of multi-unit developments and related legislation resting with her Department; and if she has made representations to the Minister for Housing, Local Government and Heritage in respect of transferring responsibility for same to his Department. The Multi-Unit Developments Act 2011 (‘MUDs Act’) was enacted with the primary purposes of reforming the law relating to the ownership and management of common areas of multi-unit developments, and facilitating the fair, efficient and effective management of owners' management companies (OMCs).

My Department has had responsibility for the MUDs Act since its preparation and enactment. However, as the policy-holder in matters of housing policy is the Department of Housing, Local Government and Heritage, my Department is guided by that Department as regards policy in this field.

My Department continues to constructively engage with that Department to ensure the effective implementation and review of the MUDs Act.
