The Health Products Regulatory Authority (HPRA) is the competent authority in respect of the use of animals for scientific purposes within Ireland. Any project on animals conducted in Ireland must be evaluated by the HPRA in accordance with Directive 2010/63/EU of the European Parliament and of the Council on the protection of animals used for scientific purposes.

This Directive seeks to replace the use of live animals for scientific and educational purposes as soon as it is possible to do so. This legislation applies throughout the European Union and is transposed into Irish law by the European Union (Protection of Animals used for Scientific Purposes) Regulations 2012 (S.I. No. 543 of 2012). Projects must be justified from a scientific point of view or required by law, and must be conducted in the most humane and environmentally sensitive manner possible. This legislation does not apply to any research conducted outside of the European Union. The HPRA does not have a role in conducting an inquiry into alleged breaches of the Global Code of Conduct for Research involving research on animals which was conducted outside of Ireland.

Abortion Services

It is Government policy that termination of pregnancy services under the Health (Regulation of Termination of Pregnancy) Act 2018 should be provided in all 19 maternity hospitals.

Currently 12 of the 19 maternity hospitals are providing termination of pregnancy services, as prescribed in the 2018 Act, which includes termination in early pregnancy (i.e. under 12 weeks) as follows:

• National Maternity Hospital, Holles Street

• Coombe Women & Infants University Hospital

• Midland Regional Hospital, Mullingar

• Rotunda Hospital

• Our Lady of Lourdes Hospital, Drogheda

• University Hospital Galway

• Mayo University Hospital

• University Maternity Hospital Limerick

• Cork University Maternity Hospital

• University Hospital, Kerry

• University Hospital, Waterford

• Sligo University Hospital

The HSE has advised that all maternity hospitals/units also offer a range of support services for the termination of pregnancy, including:

• Supporting women with any post termination complications

• Provision of ultrasound scanning, where required, and

• Management of Fatal Foetal Anomaly cases.

The HSE continues to engage with the seven remaining maternity hospitals to enable the provision of services by year end 2023.

In some hospitals the service is dependent on the recruitment of additional consultant obstetrician gynaecologists. This recruitment is progressing, as is the establishment of the appropriate referral and care pathways within those hospitals.

Termination services in early pregnancy are also provided through GPs and Women’s Health Service Contractors in the community sector, ensuring a national geographic spread and the availability of the service in all counties.

The Public Service Sick Leave Scheme, which applies to teachers and SNAs, is currently regulated by the Public Service Management (Sick Leave) Regulations 2014, S.I. No. 124/2014, as amended by the Public Service Management (Sick Leave) (Amendment) Regulations 2015, S.I. No. 384/2015.

Changes to the Public Service Sick Leave Scheme took effect from the 4th September 2023, as a result of the legislative amendment of S.I. 124/2014 Public Service Management (Sick Leave) Regulations.

The amendments enact the recommendations that emerged from a review of the Public Service Sick Leave Scheme (which took place in 2015/2016 in collaboration between the Department of Public Expenditure, NDP Delivery and Reform, management representatives from across the public service, and trade union representatives) and from the associated Labour Court Recommendation (LCR21812).

The Department is currently in the process of drafting revised Sick Leave Scheme Circulars for teachers and SNAs, to reflect the amendments to the Sick Leave Regulations. Following consultation with Education Partners, comments are being considered. The final Circulars will be published on the Department of Education website as soon as they are available.

The Department also issues Circulars for staff other than Teachers and SNA’s in ETB’s, and these will be published shortly after the publication of Teacher / SNA Circulars.

Adult Education Provision

Following discussions with the Department of Public Expenditure, National Development Plan Delivery and Reform, approval for an offer to be made to the unions was agreed earlier this year. The proposal is that a grade of Adult Educator will be formally established with a standardised payscale aligned with the Youthreach Resource Person Scale. This grade will apply to tutors employed in ETBs to deliver FET programmes, who are currently employed under a variety of terms and conditions. The provision of a pay scale will allow for incremental progression and a career path for Tutors in the further education and training sector.

A number of meetings took place over the summer regarding the details and operational aspects of the offer. My Department, and the Department of Education which retains regulatory responsibility for the ETB sector, are considering the approaches suggested to a number of issues raised with a view to reverting to the unions as soon as possible.

Apprenticeship Programmes

Currently, there are 73 national apprenticeship programmes available in Ireland. Of these, 58 have no qualifying criteria associated in regards to colour blindness. More generally, to support apprentices, information is sought at the point of registration on any additional supports that may be needed due to a disability. Education and training providers offer learning and other supports to apprentices during their training and many employers also provide accommodations in the workplace to apprentices with disabilities. Approximately 3% of the apprentice population have declared one or more disabilities, and are receiving additional supports. A majority of these identified themselves as having dyslexia or other disabilities related to learning.

However, for a small number of professions, trichromacy (i.e. normal colour vision) is an important ability to possess, on the grounds of safety. For our apprenticeships, this impacts on the participation requirements for 15 programmes. Specifically, for these programmes apprenticeship applicants must pass the Ishihara colour vision test without the use of corrective lenses.

The list of apprenticeships that this requirement applies to is set out below.

My Department is strongly committed to supporting the health of the population through the provision of graduates with the key competencies and skills to be effective in the health workforce, and support a range of clinical teams in our health services.

There is no quota placed on dental courses by my Department, and therefore the places offered are a matter for the higher education institutions, in line with their autonomy. However due to the high level of practical work involved there are material constraints on the number of students that can be accepted onto dentistry courses.

My officials are actively engaging with the Department of Health on determining the longer term skills needs of the healthcare services, and the role which the further and higher education sector can play in meeting those skills needs. I will ensure that there is continued engagement with all stakeholders to ensure that we deliver graduates with the skills necessary to support our healthcare system and support the strategic workforce planning by the health sector.

Following on from an Expressions of Interest process conducted by the Higher Education Authority, in June the Minister for Health and I announced a number of options to develop more substantial medium term additionality in priority healthcare disciplines which included dentistry. I continue to engage closely on this matter with Government colleagues to advance the process with investment to be considered in the context of Budgetary processes and the National Development Plan review.

My Department allocates funding to Skillnet Ireland through the National Training Fund. Working with Skillnet Ireland, my Department is committed to supporting the talent needs of the Irish SME sector.

Skillnet Ireland awarded some €1.5m funding to the MentorsWork scheme for 2023. Accordingly, a 50% increase in funding to MentorsWork in 2024 would bring the cost to some €2.25m. As the Deputy will appreciate, the allocation Skillnet Ireland makes for its individual schemes and networks is contingent on the overall funding allocated to it and the effective performance of each Skillnet Network or scheme. Skillnet Ireland will confirm the 2024 budgets for its Networks and Schemes before the end of the year.

Student Accommodation

Deputy Dara Calleary asked the Minister for Further and Higher Education, Research, Innovation and Science if he is aware that student accommodation providers with the backing of the colleges around the Dublin area are proposing to move to 51-week contracts for students from next year; if he will acknowledge that a student who wanted to avail of student accommodation again for next year will have to sign up to a new contract and pay for the summer months when they are not there at all; if he will engage with the colleges, with a view to cancelling this planned change; and if he will make a statement on the matter. The Residential Tenancies Act (as amended) 2019 brought Student Specific Accommodation (SSA) under the remit of the Residential Tenancies Board (RTB) on the 15 July 2019.

Section 19 b of the Act, provides that a person shall not be required, for the purpose of securing a tenancy, to make any payment other than;

" (a) an advance payment of rent, which shall be no greater than the amount of rent payable under the tenancy agreement in respect of a period of one month, and

(b) a deposit of an amount no greater than that payable under the tenancy agreement as rent in respect of a period of one month. "

This means that a person cannot be expected to pay more than two months’ rent i.e one month’s deposit and one month’s rent in advance to secure a lease.

In addition, Section 19 B (2) of the Act provides that;

"a tenancy agreement, shall not provide for an advance payment of rent, during the currency of the tenancy, which exceeds an amount that is payable under the tenancy as rent in respect of a period of one month."

This means that a tenant is not required to pay more than one month's rent in advance during their tenancy.

A further protection of the Act refers to the required notice of termination;

Paragraph 2 (c) of Section 66 of the Act, provides that in the case of Student Specific Accommodation;

"the period of notice to be given in respect of a tenancy referred to in subsection (1A) of Section 3 by the tenant and specified in the notice of termination shall be 28 days or such longer period as the tenant choose."

This mean that students residing in Student Specific Accommodation (SSA) are only required to give 28 days’ notice to the provider of SSA, if they want to terminate the tenancy arrangement. These students can give a longer period of notice if they wish, but there is no requirement in law to do so.

Officials from my Department have engaged with HEI representatives who have indicated that their members have not sought nor been informed of a move to a 51 week letting period by private providers of student accommodation.

As part of Budget 2024, I secured a significant cost of living package for third level students, including a €1,000 reduction in the student contribution fee for higher education students who are eligible for the free fees initiative in 2023/24.

The overall application of the reduction in 2023/24 fees payable by eligible students and the provision of any refunds due for eligible students will be administered with the assistance of the higher education institutions (HEIs). This process will be concluded shortly.

Ensuring a supply of qualified vets to meet the demands of Ireland's agri-food sector is an important issue for my Department.

As you are aware, a number of institutions put forward proposals following the recent HEA Expression of Interest process outlining options for the expansion of existing veterinary medicine provision.

There is a substantial capital cost associated with the provision of any new school in veterinary. It is important that the scale of the costs is fully understood and planned for and the options identified have the potential to transform the numbers of students who can take up places in these programmes. This would represent a significant investment of public funding in our higher education institutions.

Detailed discussions are continuing to take place about the ways and means to address capital costs for the provision of any new school, including in the context of an expected upcoming review of Departmental National Development Plan allocations.

Given the nature of the discussions and the significant costs associated with expansion and the provision of any new schools, it will naturally take some time for these discussions to reach a conclusion.

I am continuing to work with the Ministers for Agriculture, Food and the Marine and the Public Expenditure, NDP Delivery and Reform on the next steps.
