431 Mr. Ferris asked the Minister for the Environment and Local Government the way in which a person (details supplied) who owns land and whose sporting rights have been given to a gun club can secure the right to shoot on their own land in view of the fact that the club refuses membership to this person; and if the club has the right to refuse membership. 432 Mr. Ferris asked the Minister for the Environment and Local Government if the sporting rights for land currently held by a person (details supplied), which were reserved for the Land Commission by order LRC 649-59059 and are now held by Dúchas, can be transferred to this person. [4604/03]

I propose to take Questions Nos. 431 and 432 together.

The management of the sporting rights referred to in the Deputy's questions, which were originally reserved for the Land Commission, is now vested in my Department. At present the exercise of these is the subject of legal proceedings between the landowner and the gun club. Therefore, it would not be appropriate for me to speculate on any changes in the leasing of the rights.

My Department has no function in relation to the constitution of the club and the exercise of membership rights.
