1354 Mr. Ring asked the Minister for Social and Family Affairs when a disability benefit appeal will be finalised for a person (details supplied) in County Mayo. [20034/03]
The person concerned was in receipt of disability benefit from 5 November 2002. Payment was disallowed by a deciding officer from 29 July following an examination by a medical assessor from my Department who considered that the person was capable of work. She appealed this decision to the social welfare appeals office. The necessary papers for the appeal are being prepared and, when finished, the case will be referred to an appeals officer for early consideration.
Social welfare legislation decisions in relation to claims must be made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.
