Vol. 3 No. 35

CIVIC GUARD (ACQUISITION OF PREMISES) BILL, 1923. - FOURTH STAGE.

Mr. O'HIGGINS

I move: "That this Bill be received for final consideration." There are some amendments.

I second that.

I move an amendment to Section 3: "Sub-section (2), line 26, to delete the word `occupied'; line 27, to delete the words `the occupier thereof,' and to insert in lieu thereof the words `any person (other than a caretaker) who was put out of occupation of such premises or any part thereof in order that the same might be used for the accommodation of members of the Civic Guard.' " This amendment is moved because of an undertaking given by the Minister for Home Affairs when the Bill was in Committee. I think also it meets the views expressed by Deputy Cathal O'Shannon.

The sub-section would then read: "Whenever the Commissioners acquire any premises under this Act, any person other than a caretaker who was put out of occupation of such premises or any part thereof in order that the same might be used for the accommodation of members of the Civic Guard shall be entitled to reasonable compensation for disturbance, the amount of which shall in default of agreement be fixed by the Commissioners."

Question put and agreed to.
Question: "That the sub-section, as amended, stand part of the Bill," put and agreed to.

I beg to move in Section 6, after the word "building" [the word "premises" means any house or other building] to insert the words "or part of a house or building."

Question put and agreed to.
Motion made and question put: "That this Bill be received for final consideration" (Mr. O'Higgins).
