Vol. 38 No. 16

Ceisteanna—Questions. Oral Answers. - Flooding of Kerry Lands.

asked the Minister for Lands and Fisheries if he is aware that assurances were given, at the time of vesting, to tenants of the J.H. Cronin Estate, County Kerry, that the flooding of the tenants' lands would be remedied; and if he will now state the cause of delay in carrying out this work.

The Deputy probably refers to the estate of John H. Cronin, Record No. E C 4814, which was vested in the tenant purchasers under the Irish Land Acts, 1903-09, in the years 1926 and 1927, in accordance with purchase agreements entered into by them direct with the vendor.

The Land Commission are not aware that any assurance was given to the tenants at the time of vesting that works would be undertaken to prevent flooding of the lands. The purchase agreements contain no reference to the matter.

The Land Commission investigated a complaint as to the flooding of part of the lands of Parknasmuttaun in the occupation of William Keane, Michael Collins and William Fitzmaurice in the year 1928, but found that to deal effectively with the flooding it would be necessary to erect an embankment, the cost of which and of its maintenance would be out of all proportion to the benefit derived from it. The applicants were informed that the Land Commission could not take any action in the matter.
