asked the Minister for Local Government if he is aware that the Cork County Manager refused to comply with a resolution passed by the Cork County Council requesting him to disclose to the council members a report of the findings of a public sworn inquiry, but that the report was given privately to the chairman and other members of the County Council by the Manager; and what action his Department intends to take on this matter.

I am not so aware. I have no information in regard to this matter beyond what has appeared in Press reports. From these it appears that the County Manager was advised by the Council's Solicitor that the matter was still sub judice at the time of the Council meeting and that, in view of this advice, the Manager deferred disclosing to the Council the terms of a letter he had received from the Department of Health until it would be proper for the Council to discuss the matter. If the position is as reported in the Press, I cannot see what action the Deputy considers my Department should take in regard to it. I may say that I have received no complaint from the Council regarding the Manager's decision.

I wonder would the Minister for Local Government consult with his colleague, the Minister for Health, and tell the council whether their view was right or wrong in believing it was not sub judice?

In regard to that matter, the council have certain rights in regard to these things and they did not see fit to operate those rights. There is nothing I can add to what I have already said.
