asked the Minister for Local Government if he was aware when he granted permission on appeal to Mr. Ryan, Irishtown, Clonmel, County Tipperary, for the erection of a petrol filling station on his land at Silversprings, Clonmel that the site should have been referred to as Davis Road and not Silversprings, as this is a specific description of a residence in the locality; and if he is aware that because the site was improperly described the residents of Davis Road were deprived of an opportunity of objecting; and if he will make a statement on the matter.

I was not so aware. The order of the Planning Authority referred to Davis Road. A valid appeal was made against the grant of permission to Mr. Ryan and my order determining the appeal also referred to Davis Road.

The Permission Regulations require notice to be given before application is made to the planning authority and it is a matter for them to satisfy themselves that the notice is not misleading or inadequate. I am informed that they were so satisfied in this case, that the area where the site is located is commonly referred to as Silversprings and that an adjoining road junction is known as Silversprings Cross.

The regulations require the notice to state the location of the land. They do not specifically require the townland or road to be stated. In view of the fact that I received an appeal and also representations from a number of objectors, I am not satisfied that residents were deprived of an opportunity to object.
