asked the Minister for Justice how many burglaries have been reported in the Garda area served by Donnybrook Garda station in the period of 12 months ended 28th February, 1970.

15.

asked the Minister for Justice how many cars have been reported as missing in the Donnybrook Garda station area during the 12 months ended 28th February, 1970; and how many of those reported missing have not been recovered.

16.

asked the Minister for Justice how many prosecutions have been initiated in respect of (a) burglaries and (b) the taking of cars in respect of the Donnybrook Garda station area during the 12 months period ended 28th February, 1970.

With your permission, a Cheann Comhairle, I propose to take Questions Nos. 14, 15 and 16 together.

I assume that the Deputy intends the question relating to burglaries to include housebreaking, etc. I am giving in a tabular statement the statistics that are available for the year ended 28th February, 1970, and, with your permission, a Cheann Comhairle, the statement will be included in the Official Report. I should like to point out, however, that, in relation to a period ending as recently as 28th February, there is a presumption that further prosecutions can be brought later in respect of some of the offences still under investigation.

Following is the statement:

N.B.: The offences of (1) burglary and (2) housebreaking are separate and it is necessary to differentiate between them. In the case of burglary, the time must be the night i.e. from 9 p.m. to 6 a.m., the place must be a dwelling-house and there must be breaking and entering with intent to commit a felony. Housebreaking is (1) breaking and entering a dwelling-house, shop, warehouse, etc., and committing a felony there or (2) entering a dwelling-house in the night or breaking and entering a dwelling-house, shop, warehouse, etc., with intent to commit a felony.
