asked the Minister for Lands if he will amend the Land Act, 1965, so as to permit sub-division without consent of the Land Commission when the area to be sub-divided is certified in the Deed of Transfer to be for the erection of buildings.

The procedure for obtaining consent to the sub-division of holdings for the provision of building sites is quite straightforward and applications are dealt with promptly. However, the Land Commission have, for some time, been examining the feasibility of further simplifying the system. It is not only the granting of consent which is involved—the apportionment of annuity and possible redemption of part also fall to be arranged—and the Land Commission have to be approached on that anyway.

The Deputy may be aware that a general consent has already been granted to local authorities in respect of plots required for their statutory purposes. All that is required under this simplified arrangement is a letter from the local authority notifying the Land Commission of the sub-division. A simple formula enables the authority concerned to apportion the annuity and arrangements are then made for redemption of the part placed on the lands being transferred.

Would the Minister not agree that the annuity would not be a problem in private sales where the parties could agree among themselves to adjust it and then go to the Land Commission? While the Department deal quickly with applications for building sites, much time would be saved if the necessity to go to the Land Commission could be removed.

The Deputy mentioned about the apportionment of the annuity?

Yes. It could be a matter between the vendor and the purchaser.

That is something that could be examined.
