Written Answer. - Planning Permission Application.

asked the Minister for Local Government whether a person (name supplied) was refused permission by his Department to open a fish and chip shop and what steps his Department intend to take in this matter.

On the 24th November, 1971, planning permission was refused by me on appeal for the construction of a preparation room in connection with the sale of fried fish and chips and for the alteration to a shop front on the site referred to by the Deputy. The reason for refusal was that the proposed development would seriously injure the amenities of residential property in the vicinity by reason of the noise, disturbance, and odours which would be associated with it.

It is not clear what the Deputy means by the second part of his question; if it is a question of enforcement, this is a matter for the Dublin Corporation.

The remaining questions will appear on tomorrow's Order Paper.

I wish to raise the subject matter of Question No. 23 of 30th November last on the Adjournment. I was told last week when I raised this matter that I could not raise it then.

The Chair will communicate with Deputy Allen.

May I have your permission to raise on the Adjournment the question of whether the Taoiseach proposes to make an inquiry into the circumstances of the shooting of a young boy in Coalisland this morning?

This question has been ruled out of order. The Deputy may not get around it in this disorderly fashion. The Deputy has been given the reason.

I am simply asking would it be possible to raise it on the Adjournment.

No, because the question is not in order.

I understood that under Standing Orders I could ask for it to be raised on the Adjournment.

Requirements of urgency are laid down in Standing Orders. There are longstanding precedents in this case.

Could I not raise the subject matter of that question on the Adjournment?

The Chair will consider the Deputy's request. I am sorry. I understood the Deputy wanted to raise it now.
