asked the Minister for Industry and Commerce if he is satisfied that regulations regarding the display of price lists are being observed, especially in the larger supermarkets in Dublin.

I am satisfied that traders in general are observing the terms of the Retail Prices (Food) Display Order, 1973 and the Retail Price (Beverages in Licensed Premises) Display Order, 1972. Recent investigations carried out by the inspectorate of my Department in Dublin supermarkets, have indicated a very high degree of observance. An active policy of prosecution for contraventions of these orders is being pursued.

In view of the daily increasing cost of various food items——

This is an injection of new matter into the question.

This is something similar to what Deputy MacSharry was asking. I am asking the Minister if there is any allowance for the daily increases. At the weekend it was found by shopkeepers that there were 25 increases in that week. If the price list is not in order, according to the Minister's standards, the shopkeepers would be summoned but otherwise they would be at a loss?

There is a need for commonsense and balance in the application of these Orders and I believe there is such. Where indication is given of a contravention of the order, and there are valid grounds for it, or a genuine mistake has occurred, we are not ruthless in the prosecution of people. On the other hand, the order exists for the protection of the public. Were they not to be seriously applied in cases where genuine contravention exists, they would lose their effect and the public would lose its protection.

In view of the continuing rise in these items would the Minister not think it would be better to fix it on the profit margin?

It is a thinkable way, but provides considerable difficulties when one reaches retail level. When there are a smaller number of firms, such as importers and distributors, we do that; but retail outlets are so very numerous and varied in size that there is a real practical difficulty in monitoring at retail outlet level.

If a consumer requests a manager to show him where the list is and the manager refuses, what action can the consumer take to have the regulations enforced? Does he get in touch with the Minister's Department?

Yes, and I would urge Deputies who know of contraventions to get in touch with my Department. We would be happy to respond straight away to information.

Would the Minister instruct his inspectors when interviewing shopkeepers to be more courteous and better mannered in their approach?

If the Deputy has evidence of discourtesy I would be happy to hear it. If I find it is validated I will certainly convey my disapproval.
