Written Answers. - Retirement of Hospital Officer.

asked the Minister for the Environment the maximum number of years that would be added in the case of a 54-year-old employee of officer grade of a psychiatric hospital, who is obliged to retire from his employment on the grounds of being permanently incapacitated.

The superannuation of officers employed in psychiatric hospitals is governed by the Local Government (Superannuation) Acts, 1956 and 1980, and can, depending on options exercised by the officer in the past, be affected by other enactments including the Mental Treatment Acts, 1945-1961, and by the Superannuation Revision Scheme, 1977. Under the legislation the determination of superannuation awards is a matter for the employing authority in the first instance, officers aggrieved by the failure of an authority to make an award or by the amount of such award having a right of appeal to me.

It would not be possible on the basis of the information furnished by the Deputy to give a definite answer to his question and in any event, in view of my appellate functions, it would not be appropriate for me to do so.
