asked the Minister for Finance the reason a person (details supplied) in Dublin 11 was not promoted to assistant superintendent in the Ordnance Survey Office under (a), (b), (c), (d) and (e) of section 17 (1) of the Civil Service Commission Act, 1956; and the reason the agreed procedures outlined in his Department's circular [No. 34 of 1976] were not complied with in his case.

(Clare): The terms of section 17 (1) of the Civil Service Commissioners Act, 1956, which apply to recruitment to the civil service by way of competition are not relevant to this question which relates to the promotion of an officer. I am informed by the director of Ordnance Survey that the person named was not considered suitable for promotion in view of the extent of his sick absence record. He was advised to this effect both orally and in writing but did not exercise his further right to appeal as provided for in the appropriate circular relating to promotions.
