asked the Minister for Education if he will consider having theology included in the subjects that would qualify for university grants.

asked the Minister for Education his Department's policy in grant-aiding theology in our universities; and if he will make a statement on the matter.

I propose to take Questions Nos. 2 and 25 together.

The whole question of grant-aiding the teaching of theology in universities and the payment of grants under the higher education grants scheme to students of theology will be considered in the light of legal advice which I am awaiting concerning the general implications of Article 44.2.2º of the Constitution relating to the State endowment of religions and the specific provision in section 7 of the Irish Universities Act, 1908, which precludes the payment of State grants inter alia, “for the provision or maintenance of any theological or religious teaching or study”. Pending receipt and consideration of this advice it will be appreciated that I am not in a position to make any further statement on this matter.
