asked the Minister for the Environment if following the many representations made by and on behalf of the residents of Chapelizod he would direct that the level of the Chapelizod by-pass be dropped, thus eliminating the need for tunnels at Lynch's Lane and Chapelizod Hill.

Primary responsibility for the planning and execution of the Chapelizod by-pass rests with Dublin Corporation. The preliminary proposals for the scheme, as approved by the local authority, envisage the extinguishment of the public right of way over Lynch's Lane, where it would be intersected by the by-pass, while maintaining pedestrian and limited vehicular traffic at the Chapelizod Hill intersection.

The local authority have made an order under the Planning Acts to extinguish the public right of way over the relevant section of Lynch's Lane. The order requires my approval. Since objections to the order have been made to me, I must cause an oral hearing to be held and afford persons making the objections an opportunity of being heard. There will be no avoidable delay in making arrangements for the oral hearing and in making a determination in the matter. In view of my quasi-judicial functions in relation to the oral hearing, the Deputy will appreciate that it would not be appropriate for me to make any further comment on this aspect of the scheme at this stage.

The local authority are at present preparing detailed engineering designs for the intersections of the scheme with Lynch's Lane and Chapelizod Hill. It is a matter for the local authority to consider, in this context, any representations made by local residents.
