Written Answers. - Casual Trading Licence.

Question:

101 Mr. J. Mitchell asked the Minister for Enterprise and Employment if his attention has been drawn to the fact that under the present casual trading law the holder of a casual trading licence can pass it on to one of their family; his views on whether this has been a great tradition for many centuries especially in Dublin; and if he will ensure that this tradition will continue.

Under the Casual Trading Act, 1980, any person is entitled to obtain a casual trading licence from the Minister for Enterprise and Employment unless the person has been convicted of two or more offences under the Act.

A licence issued under the 1980 Act is valid for a period of 12 months. The Casual Trading Bill, 1994 proposes that the local authorities, to whom the licensing function is being devolved under the Bill, may issue licences to a person authorising that person to trade on specified days and for a period not exceeding 12 months. The Bill does not propose to alter a person's basic entitlement to a licence.

I have no function in regard to the question of a casual trader being facilitated in passing a trading pitch from one family member to another. This has been, and will continue to be, a matter for the local authorities to determine.
