Vol. 3 No. 22

CEISTEANNA—QUESTIONS. [ ORAL ANSWERS. ] - RELEASED PRISONER'S REARREST.

asked the Minister for Defence if he is aware that James J. McGlynn, of 8 Eglinton Terrace, Donnybrook, contractor at Portobello Works, was arrested on 21st February last, and released after his solicitors had satisfied the military authorities that there existed no ground for interning him, and that Mr. McGlynn was, nevertheless, re-arrested on 15th May, and is now in Mountjoy Jail; and that Mr. McGlynn, both on his former arrest and on his present arrest, has signed the prescribed undertaking, and that he is in fact wholly unconnected with the rebellion; and if in these circumstances the Minister will direct that Mr. McGlynn be released forthwith; further, to ask the Minister for Defence whether the one-ton Ford delivery van seized from Mr. McGlynn as long ago as 21st February last will now be returned to him, with compensation.

My information in the case is that McGlynn was arrested on the 21st February last by C.I.D. officers at his place of business at Portobello Bridge on reliable information on received to the effect that he knowingly allowed the Ford car referred to to be used for illegal purposes by Irregulars. McGlynn was released on the 5th April on signing the prescribed form of undertaking. He was re-arrested on the 15th May by C.I.D. officers on the ground, I understand, that his undertaking could not be relied on. It is not considered advisable to release him at present.

The question of the return of the Ford van, which was seized by C.I.D. officers also, cannot be considered at present.
