Vol. 6 No. 12

LOCAL GOVERNMENT (COLLECTION OF RATES) BILL, 1923.—(Fourth Stage.)

SECTION 2.

I beg to move:—

In Section 2 (1), page 3, line 20, to insert the word "poor" before the word "rate-collector."

It is only a poor-rate collector who is to have the powers intended to be conferred by the Section, and for that reason it is necessary that the word "rate-collector" should be converted into "poor-rate collector."

Amendment agreed to.
Section 2, as amended, ordered to stand part of the Bill.
SECTION 3.

I beg to move:—

In page 3, Section 3, line 44, to insert after the word "shall," where the same first occurs, the words "so long as he continues to be a rate-collector."

The purpose of the amendment is to make it clear that the powers conferred by the Section on a rate-collector shall not be exercisable by him after he has ceased to be a rate-collector.

Amendment agreed to.

I beg to move:—

In page 3 to add to Section 3, a new sub-section as follows:—

"The rights, remedies and powers conferred by this section on a rate-collector, save and except the power of distraint, shall continue after he has ceased to be a rate-collector to be exercisable by him in respect of a rate collectable, but not actually collected by him while he was a rate-collector."

The object of the amendment is to enable the powers, other than the power of distraint, conferred by the Section to be exercised by a rate collector after he has ceased to hold office. The reason is that rate collectors under their bond very often lodge money themselves which they have not collected, and it is desirable that they should have the right to recover the money so lodged by them.

Amendment agreed to.
Section 3, as amended, ordered to stand part of the Bill.
Motion made: "That the Bill, as amended, be received for final consideration."

I object.

Question put and declared carried.
Fifth stage ordered to be taken on Friday.
