CEISTEANNA—QUESTIONS. ORAL ANSWERS. - A CO. GALWAY WRIT.

asked the Minister for Agriculture if he can state whether a writ was issued against Michael Mahony, of Springarden, Tynagh, Loughrea, Co. Galway, for half a year's annuity, amounting to £8 10s. 0d.; whether judgment was obtained in the High Courts against him, and if his stock was seized for the amount of the judgment, with £5 14s. 9d. costs; whether it has since transpired that no such writ had been received by Mahony, that the half-year's annuity had been sent through the local Post Office to the Land Commission in due time, that the Commission accordingly gave him credit for the annuity, but insisted on retaining the cost of the judgment, which was obtained in error, and without his (Mahony's) knowledge, and whether steps will be taken to have the sum of £5 14s. 9d. paid as costs refunded to this poor man.

Deputy Cosgrave has been misinformed as to the facts. Michael Mahony's instalment was not received in the Land Commission, and accordingly proceedings were taken against him, not by writ in the High Court, but by civil bill in the County Court, and a decree obtained. The amount of the instalment in question, viz., that due on 1st June, 1922, was paid through Mr. Concannon, Local Solicitor, to credit of the Land Commission Account on 17th August, 1923.
