CEISTEANNA—QUESTIONS. ORAL ANSWERS. - FERMANAGH-MONAGHAN COMPENSATION CLAIM.

asked the Minister for Finance whether he is aware that Mr. J. J. Fox, Clonkirk, Clones, whose property was destroyed by British Forces early in 1921, when he was residing in Roslea, Co. Fermanagh, was granted a decree by the County Court Judge under the Malicious Injury Act as compensation for the loss he suffered, that the amount of such award was to be levied over the counties Fermanagh and Monaghan; that the Monaghan County Council refuse to meet the liability, claiming protection under Section 1 (3) of the Damage to Property Compensation Act, 1923; whether the British authorities are not wholly liable for the amount of such awards, and whether such claims should be dealt with by the Compensation Commission, Ely Place, and whether he will take the matter up with the British authorities at an early date.

The case of Mr. J.J. Fox, referred to by the Deputy, is one of many in which the Judge for a county now in the Northern area, levied part of the decree on a county now in the Free State. The cases in question are at present the subject of correspondence with the British Government, and pending the issue of this correspondence, it is not possible to indicate the manner in which they will be dealt with.
