Vol. 11 No. 12

CEISTEANNA—QUESTIONS. ORAL ANSWERS. - RETURN OF DISTRICT COURT DEPOSIT.

asked the Minister for Justice if his Department has received an application from Mr. Rogers, Solicitor, Tullamore, acting on behalf of Mr. John Carroll, Ballinderry Big, Kilbeggan, Co. Westmeath, for the return of a deposit of £10 stated to have been paid by the said John Carroll to Mr. Nicholas Crosbie, Knockdrin, Mullingar, Registrar of the Dáil Eireann Quarter Sessions Court, 1922; if he is further aware that this case was never disposed of by the then sitting Quarter Sessions Court, and whether he will see that this money is returned to the applicant forthwith.

An application for the refund of this money was heard and refused on its merits some months ago by Mr. Commissioner Kenny, acting in a judicial capacity under Section 17 of the Dáil Eireann Courts (Winding Up) Act, 1923. I do not propose, therefore, to order that this money be repaid.
